IMPORTANT NOTICE
These Terms and Conditions consists of a Part 1 (Competition Details) and a Part 2 (Standard Terms and Conditions, (together the “Terms”). In the event of any conflict, the Standard Terms and Conditions shall prevail, except to the extent that applicable law requires the Competition Details to apply.
By entering or participating in the Competition, all entrants and winners agree that they have read and understood the Terms and further agree to be bound by the Terms.
PART 1: COMPETITION DETAILS
PART 2: STANDARD TERMS AND CONDITIONS
Competition Period
Entries will only be considered if submitted during the Competition Period set out in Part 1. Entries received after the Competition Period will not be considered.
Entries will be deemed to be received at the time of receipt and not at the time of transmission.
Incomplete, inaccurate or unclear entries will be deemed invalid and thus disqualified.
Who May Enter
Only Entrants who meet the eligibility requirements set out in Part 1 may participate.
The following persons are excluded from participating in the Competition:
employees, directors, members, partners, agents, consultants or contractors of the Promoters;
immediate family members, spouses or life partners of such persons;
Supplier/s of goods and or services in terms of this Promotional Competition; and Promotional partners, Participating Retail Partners, printers, advertising and promotional agencies, professional advisors and point of sale staff employed by or contracted to, or providing goods or services of any kind, to all the people or entities listed above during the Promotional Competition period; and
any person involved in the administration, management or auditing of the Competition.
How to Enter
Entries must be submitted strictly in accordance with the entry mechanics set out in Part 1.
No consideration is required to enter the Competition other than the reasonable costs of transmission of entries at standard network rates.
Any fraudulent, automated or manipulated entries will be disqualified.
Prizes
The Prize(s) offered are described in Part 1.
Prize(s) are not transferable, nor exchangeable.
The Promoters reserve the right to substitute a Prize with another prize of similar commercial value if reasonably necessary.
Where and when applicable, the winner shall be liable to pay any applicable tax related to the Cash Prize(s).
Selection of Winners
Winners will be selected in a manner and on the date specified in Part 1.
An independent auditor will oversee and verify the winner selection process in compliance with section 36 of the Consumer Protection Act, 68 of 2008 (“CPA”).
The outcomes of the selection process is final and no correspondence will be entered into.
Notification and Verification
Winners will be notified using the contact details provided at entry or otherwise specified in Part 1.
Reasonable attempts will be made to contact a winner. If a winner cannot be contacted, does not respond within a reasonable period, or fails verification, the Prize may be forfeited and awarded to an alternate winner.
The Promoters reserve the right to withhold the Prize until it is satisfied that the claimant is the bona fide winner and may require reasonable proof of identity, age, proof of purchase and eligibility before awarding the Prize.
Publicity
Subject to the winner’s written consent, the Promoters may use the winner’s name, image and likeness for promotional purposes related to the Competition for a period of up to 12 (twelve) months after announcement.
A winner may decline such publicity without forfeiting the Prize.
Data Protection and Privacy
Personal information collected through the Competition will be processed in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”) and MTN’s Privacy Policy available at: Privacy Policy - Help & Support - MTN South Africa.
Personal information will be used for purposes of administering the Competition and fulfilling any legal or regulatory obligations.
Where entrants choose to receive marketing or promotional communications from the Promoters or any official competition partner, such communications will be subject to entrants’ consent. Entrants may opt out of receiving such communications at any time via the relevant communication channel.
Limitation of Liability
The Promoters and its partners will not be responsible for any loss, damage, injury or death that may occur as a result of taking part in the Competition or from using or enjoying a Prize, unless the law says otherwise.
The Promoters is not responsible for technical problems, system failures, interruptions or errors that may affect entry into the Competition, participation, or the Prize fulfilment process.
If circumstances beyond the Promoters’ reasonable control make it impossible to deliver a Prize, the Promoters will not be held responsible. Where a Prize is linked to a specific event, match or experience that is cancelled, postponed or disrupted for reasons outside the Promoters’ control, MTN will not be required to provide a replacement or alternative Prize.
Nothing in these Terms limits any rights that entrants may have, or any responsibilities that the Promoters have under the CPA.
General
In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the Promoters reserve the right, upon reasonable notice, to cancel the Competition, amend the number or nature of the Prizes, or update these Terms where reasonably necessary.
If the Prize involves any goods or services provided by a third party, the Prize will be subject to the third party’s terms and conditions.
The Competition is also subject to and must be read in conjunction with, MTN’s existing terms and conditions applicable to its website and mobile site, available at: Terms and Conditions - Help & Support - MTN South Africa
These Terms and the Competition will be governed by and construed in accordance with the laws of the Republic of South Africa.
